It is a criminal and punishable act to engage in "public gambling" and maintain a common gaming house in India, according to the PGA. According to the PGA, online fantasy sports gaming is considered an exception, whereby the provisions and punishments do not apply to games played by users who primarily use their skills and knowledge.

The states of Sikkim, Assam, Odisha, Telangana, Nagaland, and Andhra Pradesh

There are various states in India wherein the laws related to the game of skills are unclear. In this regard, it remains unclear whether the websites that provide online fantasy sports gaming services are allowed to provide these services for free. Sikkim, Assam, Odisha, Telangana, Nagaland, and Andhra Pradesh are among the Indian states without clearance to offer pay-to-play contests.
